These Accreditation Terms and Conditions (“Terms”) outline the agreement between Nagpur Portal Company (NPC) and any entity or individual (“Applicant”) seeking accreditation from NPC. By applying for accreditation, you agree to the following terms and conditions.

1. Accreditation Application

  • Application Process: To apply for accreditation, the Applicant must complete and submit an accreditation application form along with any required documentation. NPC will review the application based on the criteria set forth in the accreditation program.
  • Eligibility: The Applicant must meet all eligibility requirements specified by NPC for accreditation. NPC reserves the right to request additional information or documentation to assess eligibility.

2. Accreditation Criteria

  • Standards and Requirements: Accreditation will be granted based on the Applicant’s compliance with NPC’s established standards and requirements. These may include criteria related to quality, performance, and organizational practices.
  • Evaluation: NPC will conduct an evaluation of the Applicant’s operations, processes, and performance as part of the accreditation process. This may include on-site inspections, interviews, and reviews of documentation.

3. Fees and Payments

  • Application Fee: The Applicant may be required to pay an application fee as specified by NPC. This fee is non-refundable and covers the cost of processing the accreditation application.
  • Accreditation Fee: If accreditation is granted, the Applicant may be required to pay an accreditation fee, which covers the costs associated with maintaining and renewing accreditation. Payment terms will be outlined in the accreditation agreement.

4. Accreditation Granting

  • Decision: NPC will notify the Applicant of the accreditation decision. Accreditation may be granted, denied, or granted conditionally based on the evaluation results.
  • Certificate of Accreditation: Upon successful accreditation, NPC will issue a certificate of accreditation to the Applicant, valid for a specified period.

5. Obligations of the Accredited Entity

  • Compliance: The accredited entity must continuously comply with NPC’s standards and requirements. This includes maintaining quality and performance standards and adhering to any conditions specified in the accreditation agreement.
  • Reporting: The accredited entity must provide regular reports to NPC as required, including updates on performance, changes in operations, and any incidents affecting compliance.

6. Use of Accreditation

  • Authorized Use: The accredited entity may use NPC’s accreditation logo and reference their accredited status in accordance with NPC’s guidelines. All uses must be pre-approved by NPC.
  • Misuse: The accredited entity must not use NPC’s accreditation logo or status in any misleading or unauthorized manner. Misuse of accreditation may result in revocation of accreditation.

7. Monitoring and Reassessment

  • Ongoing Monitoring: NPC will conduct periodic reviews and audits of the accredited entity to ensure ongoing compliance with accreditation standards. The accredited entity must cooperate with these reviews and provide necessary documentation.
  • Reassessment: Accreditation is subject to periodic reassessment. The accredited entity must undergo reassessment at intervals specified by NPC to maintain accreditation status.

8. Revocation and Suspension

  • Revocation: NPC reserves the right to revoke accreditation at any time if the accredited entity fails to comply with NPC’s standards or if any violations of these Terms occur. The accredited entity will be notified of the revocation decision and any required actions.
  • Suspension: Accreditation may be suspended temporarily if the accredited entity is found to be in non-compliance with standards or if corrective actions are needed. During suspension, the accredited entity must take steps to address the issues identified.

9. Confidentiality

  • Confidential Information: The Applicant and accredited entity agree to maintain the confidentiality of any proprietary or sensitive information disclosed during the accreditation process. This information must not be disclosed to third parties without NPC’s prior written consent.

10. Indemnification

The Applicant and accredited entity agree to indemnify, defend, and hold harmless NPC, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with the accreditation process and the use of accreditation.

11. Dispute Resolution

  • Negotiation: Any disputes arising out of or relating to these Terms will be resolved through good-faith negotiation between the parties.
  • Arbitration: If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to binding arbitration in Nagpur, Maharashtra, India. The arbitration will be conducted in accordance with the rules of the Indian Arbitration and Conciliation Act.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of Maharashtra, India. Any legal action or proceeding arising under these Terms will be subject to the exclusive jurisdiction of the courts in Nagpur.

13. Amendments

NPC reserves the right to update or modify these Terms at any time. The Applicant will be notified of any significant changes, and continued participation in the accreditation program constitutes acceptance of the updated Terms.
